Proven Experience Handling Birth Injury Cases

Was your baby diagnosed with Cerebral Palsy, Erb’s Palsy, or brain damage that occurred during pregnancy or the birth process?

If so, you may have a birth injury or malpractice claim against your or your child’s doctor and his or her staff, or the hospital and its staff, and need an experienced Oklahoma birth injury lawyer to represent you and your child. Under the laws of medical malpractice, birth injury or birth trauma claims are extremely complex to investigate and pursue in court.

You and your child need an attorney well-experienced in investigating and litigating Oklahoma birth injury cases. The lawyers on our team have the experience you need to represent your birth injury case.

Types of Birth Injuries

Cerebral Palsy: This term covers a complex brain injury caused by lack of oxygen to the brain or by infection which causes damage to the brain, cognitive deficits, seizures, spasticity in the arms or legs, inability to eat and, in very severe cases, inability to breathe without the assistance of a ventilator. It is very expensive to care for such a child. Medical bills could exceed hundreds of thousands of dollars a year! The causes of Cerebral Palsy are many and varied. A significant number of babies have Cerebral Palsy because of malpractice by medical personnel during the prenatal office visits and/or mistakes during the labor and delivery process. Obviously, these are preventable birth injuries.

Brachial Plexus Palsy: The nerves of the baby’s arm run from the neck, under the shoulder, through the armpit and into the arm. These nerves can be torn during delivery such that the child is left with a permanent disability in movement and growth of its arm, hand or shoulder. This is a Brachial Plexus injury (also known as Erb’s Palsy) and is often, but not always, caused by medical malpractice during childbirth.

Other Birth-Related Injuries: During childbirth, instruments which are used to assist the delivery of the baby can cause skull fractures, bleeding in the baby’s brain, spinal cord or brain injuries or facial scarring. Additionally, certain drugs administered by the doctor or nurse during labor can cause injuries to the mother if not properly monitored and controlled (for example, rupture of the uterus; and abruption or tearing of the placenta). Sometimes, these birth injuries are caused by medical malpractice.

Infant Brain Damage Symptoms

In infants it can be harder to detect birth injuries. Some common symptoms of infant brain damage include:

  • an abnormally small head
  • an abnormally large forehead
  • a malformed spine
  • neck stiffness
  • unusual or distorted facial features
  • abnormal eye movement
  • seizures

Cerebral palsy specifically can have some very telling symptoms in young children. To name just a few:

  • tight or stiff muscles
  • an abnormal gait
  • weak or paralyzed muscles
  • muscle spasms or tremors
  • delays in reaching milestones
  • difficulty with find motor skills
  • floppy muscles and joints
  • difficulty swallowing

Medical Malpractice & Birth Injuries

In a birth injury case, under the laws of medical malpractice damages may be recovered for you or your child if the involved health care professionals failed in a relevant way to follow or abide by the usual standards of care or rules set by the healthcare profession. This is what is meant by medical negligence resulting in birth injury.

Our law firm is highly experienced in handling cases that result in medical negligence claims and birth injury lawsuits. Children who are injured require the most care, and, unfortunately, the medical bills add up very quickly. Parents who think their children have been damaged during childbirth are urged to contact us immediately discuss your birth injury case.
